Professional Bio

  • Ivelisse Berio LeBeau has been working in the employee benefits law field for more than 25 years. In private practice she has counseled sponsors of multiemployer pension and welfare benefit plans; assisted health plan sponsors in complying with the Affordable Care Act; worked with benefit plan sponsors and fiduciaries during U.S. Department of Labor investigations; and defended benefit plan fiduciaries in federal and state court actions alleging breaches of fiduciary duty, challenging trustee decisions, or seeking plan benefits. Earlier in her career Ivelisse served as a Trial Attorney in the Office of the Solicitor of the U.S. Department of Labor, where she represented the DOL in lawsuits brought under ERISA alleging that fiduciaries to employee pension and welfare benefit plans breached fiduciary duties imposed by ERISA or were engaged in transactions prohibited under ERISA, including actions against fiduciaries who had made imprudent investment decisions, and against service providers who generated and retained undisclosed indirect compensation.

    Ivelisse is Editor in Chief of Employee Benefits Law, 4th edition, published by Bloomberg BNA in 2017, and the Winter and Fall 2018 Supplements to the Fourth Edition. The book is the leading legal treatise covering employee benefits law practice in Bloomberg Law’s library of legal texts. She was also co-editor of Employee Benefits Law, 3rd edition, published by Bloomberg BNA in 2012, and Editor in Chief of the 2014 and 2015 Supplements to the Third Edition. Ivelisse is a frequent speaker on employee benefits law topics at conferences, seminars, and webinars sponsored by organizations such as the American Bar Association’s Joint Committee on Employee Benefits and the Florida Bar Labor & Employment Law Section.

    In 2015 Ivelisse was inducted as a Fellow of the American College of Employee Benefits Counsel. She is also a longtime member of the Employee Benefits Committee of the American Bar Association’s Section of Labor & Employment Law.

    Ivelisse is a graduate of Mount Holyoke College and a cum laude graduate of Boston College Law School. Following law school she served as a law clerk to the late Honorable Joseph P. Warner, former Chief Justice of the Massachusetts Appeals Court.

    Ivelisse is bilingual and bicultural, crediting her fluency in Spanish to her Puerto Rican roots.

    • Ms. Berio LeBeau served as Editor in Chief of the Fourth Edition of Employee Benefits Law, published by Bloomberg BNA in 2017, and of the 2018 Supplements to the Fourth Edition; she also served as Editor in Chief of the 2014 and 2015 Supplements to the Third Edition of the treatise, and as Co-Editor of the Third Edition, published in 2012. Employee Benefits Law is a legal treatise covering key aspects of employee benefits law practice, including the regulation of health care benefit plans, ERISA fiduciary duties, ERISA litigation, reporting and disclosure requirements, regulation of multiemployer benefit plans, ERISA preemption, and the foundations of Internal Revenue Code employee benefit plan coverage.
