EXPERT WITNESS DEPARTMENT CHAIRS & PROFESSIONALS
Expert Witness Service
Our attorneys, including Marcia Wagner, Kim Shaw Elliott, Israel Goldowitz, Stephen Migausky, Alexander Olsen, Mark Poerio and Roberta Casper Watson, have served as expert witnesses in several areas of ERISA, employee benefits, executive compensation and investment management law. They have represented clients with distinction in cases relating to plan design, benefit administration, financial issues, fiduciary matters, best practices and evolving industry standards.
What Does An Expert Witness Do
An expert witness brings specialized knowledge into a case that a judge or jury would not otherwise have access to. In ERISA and employee benefits litigation, that often means explaining how a retirement plan is supposed to work, whether a fiduciary followed accepted industry practice or how a particular investment decision compares to what a prudent plan sponsor would have done. Courts rely on this testimony to sort out technical questions that sit outside the ordinary experience of the people deciding the case. A well-prepared expert can shape the outcome of a dispute by giving the court a clear, credible framework for evaluating the facts.
Our Expert Witness Experience
Expert witness testimony by our firm’s attorneys has been noted as crucial in the success of many cases, having produced untold savings to plan sponsors and other ERISA fiduciaries, as well as recoveries for plan participants and beneficiaries and executives. Judge Katherine B. Forrest noted in her decision in favor of New York University, in the case of Sacerdote, et. al. v. New York University, with respect to Marcia Wagner’s testimony on behalf of NYU, that “[Ms. Wagner’s] experience with 403(b) plans is impressive and her testimony consistent, reasonable, logical and ultimately, highly credible.”
