Biography
Sholom Fine has been with The Wagner Law Group since 2006, specializing in ERISA and Employee Benefits. He is responsible for assisting firm clients on all issues regarding qualified retirement plans. Sholom has extensive experience representing and counseling clients whose benefit plans are under audit by the Internal Revenue Service (IRS) or the Department of Labor (DOL). In addition, Sholom also prepares Forms 5330 (excise tax on prohibited transactions), 5300/5310 (determination letter applications) and 5500 (employee plan annual returns), and he drafts defined contribution plans, summary plan descriptions and summary annual reports.
Sholom also specializes in the correction of common plan issues such as late Forms 5500, late remittances of employee elective deferrals as well as all other operational and document failures that could otherwise lead to plan disqualification. Sholom has vast experience with correction submissions under the DOL's Voluntary Fiduciary Correction Program (VFCP) and Delinquent Filer Voluntary Compliance Program (DFVCP), as well as the IRS's Employee Plans Compliance Resolution System (EPCRS) (both the Voluntary Correction Program and Self Correction Program) and the Employee Plans Voluntary Closing Agreement Program.
In addition, Sholom has experience functioning as the court-appointed independent fiduciary for employee plans, and in that role has managed the administration and termination of orphaned plans, including distribution of account balances to participants and searching for missing participants.
Sholom serves as the Chief Technology Officer of The Wagner Law Group.
